Terms of use

Using this site means accepting these terms. If you do not accept them, stop using the site. They apply to everyone who visits, whether or not you ever write to us.

Nothing on this site is an offer, a commitment, a quotation, or a reservation of capacity. Nothing here creates a contract, an exclusivity, a right of first refusal, or an obligation on us to proceed with anything. A capacity figure, a timeline, a development stage or a site description is a statement of where something stood when it was written, not a promise about where it will end up.

We contract in writing, signed, and only then. If you are relying on something you read here, ask us to confirm it in a document that someone has signed. We would rather have that conversation than have you rely on a web page.

Nothing here is investment, financial, legal, engineering or tax advice, and nothing here is an offer to sell or a solicitation of an offer to buy any security or any interest in any project.

This site is operated by Kilgore Energy LLC, an Arizona limited liability company at 11111 N Scottsdale Rd, Scottsdale, AZ 85254.

Nerd Power is a registered trade name of the same company, used for its solar and energy services work, with its own site at nerdpower.us. One legal entity operates both businesses. Nerd Power is not a subsidiary and is not a separate company, and anything you contract for with either name is contracted with Kilgore Energy LLC.

Pages on this site describe projects in development and capacity that is planned, contracted or energized. Those are statements about the future, and development is the business of things not going to plan: interconnection positions move, permits take longer, counterparties change their minds, and equipment arrives late.

Figures are given as of the date stated beside them and are not updated continuously. Projects in development are published without names, locations or counterparties, so what you see of them is deliberately partial. We do not undertake to update any of it as things change.

The text, images, diagrams, data and design on this site belong to us or to the people we licensed them from. Read it, quote it with attribution, and send it to a colleague. Do not republish it as your own, scrape it in bulk, or use it to train a model.

The Kilgore Energy and Nerd Power names and marks are ours. Nothing here grants you a licence to use them.

Do not:

• try to break, overload, probe or gain unauthorized access to the site or anything behind it
• submit anything through the form that is false, that impersonates somebody else, or that you are not entitled to disclose
• use the site to send unsolicited commercial messages to us or to anyone else

The form carries an automated check to keep it usable. Attempting to defeat it is a breach of these terms.

What you submit through the form is handled as described in our privacy policy. Unsolicited ideas, proposals or materials sent to us outside a signed confidentiality agreement are not treated as confidential, and we are free to act on anything in them without owing you anything for it. If something is genuinely confidential, get an agreement in place first.

Where this site links somewhere else, including to nerdpower.us, that site is its own responsibility. We do not control what it says or what it collects, and a link is not an endorsement.

We put real effort into keeping this site accurate and available, and we still provide it “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non infringement. We do not warrant that it will be uninterrupted, error free, or free of anything harmful.

To the fullest extent the law allows, neither Kilgore Energy LLC nor its members, managers, officers, employees or agents is liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, lost revenue or lost opportunity, arising out of your use of this site or your reliance on anything in it, even where we were told such damages were possible.

Some jurisdictions do not allow some of these exclusions, in which case they apply to you only as far as that jurisdiction permits.

You agree to indemnify and hold us harmless from any claim, loss, liability or expense, including reasonable legal fees, arising out of your use of this site in breach of these terms or of any law.

We may change these terms. The date at the top changes when we do, and the version then published governs your use of the site from that point.

These terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions, and the courts of Maricopa County, Arizona have exclusive jurisdiction over any dispute arising under them.
